Terms of Service

These terms govern access to and use of the Sablecrest service and this website. By using either, you agree to them. If you're agreeing on behalf of a company, you confirm you're able to bind it.

1. The agreement

"Sablecrest" means Sablecrest, Inc., a Delaware corporation with its principal place of business in Los Angeles, California. "You" means the studio or individual using the service. If we've signed a separate written agreement with you, that agreement controls where it conflicts with these terms.

2. Early access

The service is currently offered on an invite basis. During early access we may change, limit, or withdraw functionality, and we may end your access with reasonable notice. We'll try not to surprise you, but you should not build anything you can't roll back onto an early-access dependency.

3. Your content

You keep all rights to the bundles, configuration, and other material you publish through the service. You grant us only the licence we need to host it, transmit it to your players, and keep backups — nothing broader, and it ends when you remove the content.

You are responsible for what you publish: that you have the rights to it, and that distributing it doesn't break the law or anyone else's rights.

4. Acceptable use

Don't use the service to:

We may suspend access without notice if we reasonably believe continued use threatens the service or another customer, and we'll tell you why as soon as we practically can.

5. API keys

Keys authenticate as you. Keep them out of client binaries and version control, rotate them when someone leaves, and tell us at security@sablecrest.dev if one is exposed. You're responsible for activity under your keys until you tell us.

6. Availability

We aim to keep the service up and we publish region health at /status. We do not offer a contractual uptime commitment during early access, and you should design for our endpoint being briefly unreachable — the SDK caches bundles and keeps serving them, and you should let it.

7. Fees

Early-access participants are not charged unless we've agreed otherwise in writing. If we introduce fees, we'll give you at least 30 days' notice before they apply to you.

8. Confidentiality

Each of us may learn non-public information about the other. Neither of us will disclose it or use it for anything other than this relationship, for as long as it stays non-public.

9. Warranties

The service is provided "as is". To the fullest extent the law allows, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of these terms will not exceed the greater of the fees you paid us in the 12 months before the claim, or US$100. Nothing here limits liability that cannot lawfully be limited.

11. Indemnity

You'll defend and indemnify us against third-party claims arising from content you publish through the service or from your breach of section 4.

12. Termination

Either of us may end this agreement at any time. On termination your access stops and we'll delete your content within 30 days, other than backups that expire on their own schedule. Sections 3, 8, 9, 10, 11 and 13 survive.

13. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in Los Angeles County, California have exclusive jurisdiction, and both parties consent to venue there.

14. Changes

We may update these terms. If a change materially reduces your rights we'll give you at least 30 days' notice by email to your account administrators. Continuing to use the service after that means you accept the change.
